Who can certify patients for Kentucky medical marijuana use?

Any Kentucky-licensed physician (a doctor of medicine or a doctor of osteopathy) can certify patients for medical marijuana use. Governor Beshear outlines this process in his executive order, published in November of 2022. The executive order took effect on January 1, 2023. The healthcare provider must have a bona fide relationship with the patient, and the signed certificate must include a statement that the patient suffers from a qualifying medical condition.

Current qualifying medical conditions include:

  • ALS

  • cancer

  • epilepsy

  • intractable seizures

  • Parkinson's disease

  • Crohn's disease

  • multiple sclerosis

  • sickle cell anemia

  • severe and chronic pain, including fibromyalgia or arthritis

  • PTSD

  • cachexia or wasting syndrome

  • neuropathies

  • hepatitis C

  • Huntington's disease

  • HIV or AIDS

  • glaucoma

  • muscular dystrophy

  • terminal illness

These requirements and processes will change when Senate Bill 47, which will legalize medical cannabis, takes effect in 2025. At that time, advanced practice registered nurses (APRNs) will also be able to certify patients for medical marijuana use. There will be required training for medical marijuana practitioners who wish to prescribe medical marijuana ID cards. Updates will be posted to the Kentucky Medical Cannabis Program website.

Qualifying medical conditions in 2025 include:

  • Any type or form of cancer, regardless of stage

  • Chronic, severe, intractable or debilitating pain

  • Epilepsy or any other intractable seizure disorder

  • Multiple sclerosis, muscle spasms or spasticity

  • Chronic nausea or cyclical vomiting syndrome resistant to other conventional treatment methods

  • Post-traumatic stress disorder

There are efforts to expand this list, namely Senate Bill 337. If this bill passes, then the qualifying medical condition list would grow from six to 21 conditions.
